These Terms of Service ("Terms") govern your use of bryonslist.com (the "Site"), operated by Bryon's List, based in Elkhart, IN. By using the Site, submitting a form, creating an account, or participating in an auction listing, you agree to these Terms. If you do not agree, please do not use the Site.
Who We Are
Bryon's List is an owner-operated, Michiana-focused directory connecting homeowners with local contractors, plus occasional auction-style listings. You can reach us at [email protected].
Accounts
Some features require signing in, including with a Google account. You are responsible for keeping your account credentials secure and for activity that happens under your account. Let us know right away if you believe your account has been used without your permission.
Forms & Signups
Petition, waitlist, employer, and contractor signup forms on this Site are for genuine inquiries only. You agree to provide accurate information and not to submit false, misleading, or automated (bot) submissions. We may remove or ignore submissions that appear fraudulent or abusive, and we rate-limit form submissions to prevent spam.
Auction Listings & Payment
Some listings on this Site operate as auctions. If you place a bid, you are making a binding offer to purchase at that price if you are the winning bidder. Winning bidders are expected to complete payment through PayPal within a reasonable time of being notified. We reserve the right to cancel a listing or bid, or to re-list an item, in cases of suspected fraud, non-payment, pricing errors, or other good-faith reasons. All listing descriptions are provided by the seller and we do our best to ensure accuracy, but we do not independently verify the condition of items listed.
Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose;
- Interfere with the Site's operation, security, or normal functioning;
- Scrape, harvest, or bulk-collect data from the Site without our permission;
- Submit false or fraudulent form entries, bids, or payments; or
- Impersonate another person or business.
Intellectual Property
Content on this Site — including text, layout, and branding — belongs to Bryon's List or its licensors and is protected by applicable intellectual property laws. Content submitted by users (such as auction listing descriptions or images) remains that user's, but by posting it you grant us a license to display it on the Site.
No Guarantee of Match or Sale
Bryon's List helps connect homeowners with contractors and facilitates auction listings, but we do not guarantee that any signup will result in a completed match, that any contractor will be licensed, insured, or suitable for your project, or that any auction listing will result in a sale. Homeowners and contractors are responsible for vetting each other before doing business.
Third-Party Links & Services
The Site may link to or use third-party services, including PayPal for payment and Google for sign-in and analytics. We are not responsible for the content, policies, or practices of those third parties. See our Privacy Policy for more detail on the services we use.
Disclaimer of Warranties & Limitation of Liability
The Site is provided "as is" without warranties of any kind, express or implied, except as required by law. To the fullest extent permitted by law, Bryon's List will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site, a contractor match, or an auction transaction. Nothing in these Terms limits any right you have under applicable consumer protection law that cannot lawfully be excluded.
Indemnification
You agree to indemnify and hold Bryon's List harmless from claims, damages, or expenses arising from your use of the Site, your violation of these Terms, or content you submit.
Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law principles, and any disputes will be resolved in the state or federal courts located in Indiana.
